This document, hereinafter referred to as the "Terms," "Agreement," or "Terms and Conditions," constitutes a legally binding contract between the entity operating the ts3host.eu website and associated services (referred to as "TS3HOST.EU") and any individual or entity who creates an account, purchases, accesses, or uses the services provided (referred to as the "User," "You," or "Your").
By registering for an account, purchasing a service, or otherwise accessing or using the services offered by TS3HOST.EU, You acknowledge that You have read, understood, and agree to be bound by these Terms in their entirety. This agreement also incorporates by reference TS3HOST.EU's Privacy Policy and Acceptable Use Policy (AUP), which are integral parts of this contract. Any use of TS3HOST.EU's services shall constitute an act of acceptance of the current Terms and Conditions. If You do not agree with all of these legal terms, then You are expressly prohibited from using the Service and must discontinue use immediately.
To ensure clarity and prevent ambiguity, the following terms shall have the meanings ascribed to them below:
TS3HOST.EU provides virtualized server environments configured for the operation of voice communication software. The Service includes the allocation of specific server resources as detailed in the purchased plan, network access to make the server instance publicly or privately available, and access to a control panel for basic server management tasks such as starting, stopping, and restarting the server instance. TS3HOST.EU is responsible for the maintenance and security of the underlying physical infrastructure and network, but not the software or content operated by the User on their allocated virtual server.
This section outlines the critical legal distinction between the hosting Service provided by TS3HOST.EU and the third-party software operated by the User. The legal status of the TeaSpeak software is not formally defined by its developers, presenting potential legal risks for which the User must assume full responsibility.
To access the Service, You must register for an account. You agree to provide true, accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete.
You are responsible for maintaining the confidentiality of Your account password and for all activities that occur under Your account. You agree to immediately notify TS3HOST.EU of any unauthorized use of Your account or any other breach of security. TS3HOST.EU cannot and will not be liable for any loss or damage arising from Your failure to comply with this security obligation.
You are solely responsible for the use of Your account and the management of Your Service instance, whether used by You or any other person. This includes responsibility for all User Content, the configuration of the server software, and ensuring that all use of the Service complies with this Agreement, including the Acceptable Use Policy. For dedicated or virtual private server plans, You are obligated to maintain all security on your server, and You assume full liability for all content placed on it.
You agree to pay all fees specified for the Service plan You select. All fees are due in advance of the service period. TS3HOST.EU may offer a free trial plan for the User to evaluate the quality and functionality of the Service. The installation, delivery, and maintenance of paid services incur immediate costs for TS3HOST.EU. Therefore, all purchases are considered final and non-refundable, except as expressly provided in these Terms or as required by applicable law.
Unless You notify TS3HOST.EU before the end of the applicable subscription period that You want to cancel, Your subscription will automatically renew, and You authorize TS3HOST.EU to collect the then-applicable subscription fee for such renewal (as well as any taxes) using any payment method on record for You. The terms for automatic renewal, including the renewal period and associated costs, will be clearly communicated prior to purchase, in compliance with EU consumer protection regulations.
If Your account becomes overdue for any reason, TS3HOST.EU reserves the right to suspend Your access to the Service without notice. If the outstanding balance is not paid in full within a specified grace period, TS3HOST.EU may terminate the Service, which will result in the permanent deletion of Your server instance and all associated User Content. TS3HOST.EU is not liable for any loss of data resulting from such suspension or termination.
TS3HOST.EU reserves the right to change the fees for its Services at any time. For subscription-based plans, any price changes will take effect at the start of the next subscription period following the date of the price change. TS3HOST.EU will provide you with reasonable prior notice of any change in fees to give you an opportunity to terminate your subscription before such change becomes effective.
This section provides a precise legal definition of the "Lifetime Plan" to ensure full transparency and to manage User expectations regarding the service duration. The structure of this clause is designed to define the product's nature from the outset, rather than imposing a limitation, which is a critical distinction under consumer protection laws.
The Lifetime Plan grants the User access to the specified Service for an "Indefinite Term," as defined in Section 2 of this Agreement. The User explicitly acknowledges and agrees that the marketing term "Lifetime" does not imply a service duration for the User's natural life, in perpetuity, or for any fixed period beyond the Service Lifetime. The term is used to distinguish this one-time payment plan from recurring subscription-based plans.
The provision of the Service under a Lifetime Plan is entirely contingent upon the continued commercial operation of the Service by TS3HOST.EU. The Indefinite Term is inextricably linked to the Service Lifetime. This approach is a standard industry practice for "lifetime" digital products, where the term is defined by the operational life of the product itself, not the user's lifespan.
The Service provided under a Lifetime Plan, and the Indefinite Term itself, will terminate immediately, automatically, and without any right to refund, credit, or other compensation, upon the occurrence of either of the following events:
(a) TS3HOST.EU ceases all business operations, dissolves, or otherwise becomes insolvent.
(b) TS3HOST.EU, in its sole and absolute business discretion, decides to discontinue the TeaSpeak hosting product line. This decision may be based on factors including, but not limited to, lack of commercial viability, technological obsolescence, changes in market demand, or potential legal risks associated with the underlying third-party software.
The User acknowledges that the one-time fee for the Lifetime Plan is consideration for access to the Service for its entire operational lifetime, however long or short that may be. By purchasing a Lifetime Plan, the User accepts the risk that the Service Lifetime may be shorter than anticipated. No refunds, whether full, partial, or pro-rated, will be issued for Lifetime Plans in the event of a termination of the Service Lifetime under the conditions described in Section 6.3. Using vague or ambiguous language regarding such conditions can lead to disputes and unenforceability; therefore, this clause is intended to be explicit and unambiguous.
In accordance with European Union Directive 2011/83/EU on consumer rights, consumers residing within the EU generally have the right to withdraw from a distance contract within 14 days without giving any reason (the "Cooling-Off Period"). This section details how this right applies to the digital services offered by TS3HOST.EU.
The withdrawal period will expire 14 days from the day of the conclusion of the contract (i.e., the day of purchase). To exercise the right of withdrawal, You must inform TS3HOST.EU of Your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or an e-mail to our support address).
The Service offered by TS3HOST.EU is a digital service, the performance of which begins immediately upon completion of Your purchase to provide You with instant access to Your server instance. Under EU law, the right of withdrawal is lost for digital services under specific conditions.
As a condition of purchase, You will be required to:
This consent and acknowledgment will be obtained through a mandatory, non-pre-ticked checkbox or a similar clear affirmative action during the checkout process, immediately before You finalize Your payment. By completing the purchase after providing this consent and acknowledgment, You agree that You are waiving Your statutory 14-day right of withdrawal.
If You are eligible for and properly exercise Your right of withdrawal (i.e., if You have not waived it as described above), TS3HOST.EU shall reimburse to You all payments received from You without undue delay and in any event not later than 14 days from the day on which TS3HOST.EU is informed about Your decision to withdraw from this contract.
This Acceptable Use Policy (AUP) is an integral part of Your agreement with TS3HOST.EU and details prohibited uses of the Service. Violations of this AUP may result in the immediate suspension or termination of Your Service without refund. You are responsible for any misuse of the Service that occurs through Your account, whether by You or any third party.
The following table summarizes prohibited activities. This list is not exhaustive, and TS3HOST.EU reserves the right to determine, in its sole discretion, what constitutes a violation of this AUP.

TS3HOST.EU may suspend Your access to the Service, in whole or in part, without prior notice if:
(a) You are in breach of the Acceptable Use Policy, including being the source or target of a DDoS attack.
(b) Your account is overdue on payment.
(c) Your use of the Service poses a security risk to the Service or to other users.
TS3HOST.EU may terminate this Agreement and Your access to the Service immediately and without prior notice if:
(a) You commit a material breach of these Terms, including any violation of the AUP.
(b) Required to do so by law or by a regulatory or governmental body.
(c) You fail to cure a payment default within the specified grace period.
(d) The Service Lifetime ends, as described in Section 6.
Upon termination of this Agreement for any reason, all Your rights to access and use the Service will immediately cease. TS3HOST.EU will have no obligation to maintain or forward any of Your User Content and reserves the right to permanently delete all User Content from its systems. You are solely responsible for exporting Your User Content prior to termination.
